Do you have to go to court to separate?

In most cases, no. The large majority of family law matters are resolved by agreement, through negotiation or family dispute resolution, and formalised in a parenting plan, consent orders or a financial agreement. Court is generally a last resort for matters that cannot be agreed. We always work towards the most practical, cost-effective resolution for you and your family.

Usually not. Most parenting and property matters are settled by agreement and formalised in consent orders, a parenting plan or a financial agreement. You generally must attempt family dispute resolution first; court is a last resort. We will tell you honestly if your matter is heading that way.

There is no automatic 50/50 split. Under the Family Law Act 1975 (Cth) the court follows a process including: identifying and valuing the asset pool, assessing each party’s contributions, considering each party’s current and future circumstances, and arriving at a just and equitable outcome. Every matter is fact-specific, so early advice on your likely entitlements matters.
