Insurance

Insurance lawyers in Newcastle and the Hunter. We act on professional negligence and property and liability claims, for insurers, professionals and individuals.

Insurance law covers what happens when a claim is disputed, denied or defended, from a denied property claim to a professional negligence action. We act for insurers, professionals and individuals, drawing on the Insurance Contracts Act 1984 (Cth), the General Insurance Code of Practice and the law of negligence. We advise from our offices in Newcastle, for clients across the Hunter and NSW.

We are trusted with serious insurance work, including acting for a major insurer, and we are members of the Australian Insurance Law Association. Whichever side you are on, we give clear, practical advice aimed at the best outcome efficiently.

Why clients choose Mullane Lindsay

Our insurance work draws on our litigation team, led by Director Kristy Nunn and Special Counsel David Collins. We are trusted with serious commercial insurance work, including as the only firm a major insurer instructs in NSW outside Sydney. Backed by the firm since 1976, we bring genuine insurance expertise to both sides of a claim.

Acting for insurers, professionals and individuals

Insurance disputes look different depending on where you sit. For insurers, we defend and manage claims effectively. For professionals, we respond to negligence allegations and work with insurers. For individuals and businesses, we challenge denied or reduced claims through internal review, AFCA and, where needed, the courts. We tell you honestly where you stand and the most cost-effective way forward. We also advise on liability claims and policy interpretation, and we act for both policyholders and insurers.

FAQs

We advise on insurance disputes: defending or pursuing claims, interpreting policy terms, responding to denials and non-disclosure allegations, and acting in professional negligence matters. We act for insurers, professionals and policyholders, and we resolve most matters through negotiation, internal review or AFCA rather than court.

Both. We are trusted with serious work for insurers, including a major insurer, and we also act for professionals and for individuals and businesses challenging a denied or reduced claim. We will tell you at the outset if a conflict means we cannot act for you.

Often, yes. A denial is not the final word. You can request written reasons, seek internal dispute resolution, and escalate to AFCA, a free external scheme that can require an insurer to pay a wrongly denied claim. Time limits apply, so act promptly, and get advice if the amount is significant or the policy is complex.
