We advise pharmacists and pharmacy owners on owning and running a pharmacy: buying or selling, structuring ownership, leasing premises, and meeting the ownership rules that apply specifically to pharmacies in NSW. Pharmacy is a regulated profession, and the rules differ from an ordinary business. We advise from our offices in Newcastle, and act for pharmacists across NSW.
How we help
We know the rules that are specific to pharmacy, so you do not have to learn them the hard way. We:
- Advise on who may own a pharmacy and structure ownership to comply.
- Guide you through buying or selling, including approvals, the lease and staff.
- Negotiate and review the premises lease.
- Help with the regulatory and employment issues particular to pharmacy.
Why pharmacists choose Mullane Lindsay
Our pharmacy law work is led by Lachlan Page, and we act for pharmacists across NSW. We understand the approval and ownership rules, the role of the regulator, and the commercial realities of running a pharmacy. Backed by the firm since 1976, we bring that experience to a sector where the rules are specific and the stakes are high.
Who can own a pharmacy in NSW?
In NSW, only registered pharmacists can own a pharmacy, and there are limits on how many pharmacies one pharmacist can have an interest in. The ownership and approval rules are strict, and getting the structure wrong can put your approval at risk. We make sure your ownership structure complies before you commit, whether you are buying your first pharmacy or adding another.
Buying or selling a pharmacy
A pharmacy sale involves more than the usual business contract: approvals and licences, the premises lease, PBS arrangements, and the staff who come with the business. We run the due diligence, prepare or review the contract, manage disclosure, and handle the transfer of the lease and approvals, so the deal completes cleanly and your approval is secure from day one.
