Defects in Construction Contracts

A defect in a construction contract is any work that does not meet the standards or requirements set out in the contract. Defects can be either latent or patent.

• Latent defects are defects that are not visible or apparent at the time the work is completed. These defects may not be discovered until months or even years later.
• Patent defects are defects that are visible or apparent at the time the work is completed. These defects are usually discovered during the inspection process.
